1. The Roger Burnley Series Affiliate Agreement

This agreement describes the terms and conditions for participation in Roger Burnley Series Affiliate Program. In this agreement, the term "affiliate" refers to you (the applicant). In this agreement, "Roger Burnley Series," "Your Life Operating Instructions Series," "The Burnley Method," or "Burnley Method," refers to the product owner and publisher, Roger Burnley). The Roger Burnley Series Affiliate Program is administered through newzenler.com and their affiliate system.

From here on, the party representing Roger Burnley Series, Your Life Operating Instructions, 4 Weeks to Your Best Life, and all programs associated will be known collectively as "The Burnley Method."

2. Modification

We may modify any of the terms and conditions within this Agreement at any time and at our sole discretion. These modifications may include, but not be limited to, changes in the scope of available referral fees, fee schedules, payment procedures, and Affiliate Program rules. If any of the modifications are UNNACEPTABLE TO YOU, your only recourse is to terminate this Agreement. If you CONTINUTE PARTICIPATION IN THE PROGRAM, it will be considered as your acceptance of the change.

3. Enrollment

To enroll in the Affiliate Program, you must submit your name and email and be approved. Approvals are usually processed within 48 hours, and applicants will be notified of their acceptance status as soon as possible after their information is reviewed.

Currently, Affiliate Status is only being granted to members of 4 Weeks to Your Best Life. If you are not a member, and wish to become an affiliate, please contact us separately by emailing info@rogerburnley.com, and we will see if you are a right fit.

4. Affiliate URL

Upon approval of becoming an affiliate of The Burnley Method, you will receive a special unique Affiliate code that will link your traffic to your sales. You will have access to a "link generator" that will automatically generate the correct full URL that will link your code to approved offers, courses, and webinars. This will allow you to be paid for affiliate referrals.

5. Commissions

Affiliates will receive up to 50% of the revenue as a commission from orders placed through properly coded Affiliate links (unless noted otherwise for a particular product). Commissions may change at the discretion of the product publisher, The Burnley Method.

For a sale to generate a commission to an Affiliate, the customer must complete the order form and remit full payment for the product ordered through the secure order system. Word of mouth referrals will not result in an affiliate commission being generated. Commissions will only be paid on sales that are made when the customer clicks through qualified, correctly structured Affiliate links. Properly coded links are the sole responsibility of the affiliate.

Links may be generated to drive traffic to webinars conducted by The Burnley Method. Leads that convert from the link will be credited commission upon purchase.

Purchasers of the main product 4 Weeks to Your Best Life will have the option to be up-sold to a recurring monthly membership. Any upsell to recurring monthly payments will be commissioned to the Affiliate linked with the original sale, and will continue until the customer withdraws from membership, or at the discretion of The Burnley Method. In which case, the commission credit will end at this discretion.

6. Commission Payout

The Burnley Method utilizes NewZenler's payment and affiliate platforms, and also use portals operated by Stripe and PayPal. The Burnley Method pays affiliates via a PayPal account, with the email provided to our database upon entry by the applicant, when said applicant joins. If the PayPal email changes, it is the sole responsibility of the affiliate to log into their affiliate admin portal and render change to the correct PayPal email via the "Payment Settings" tab, and subsequent email change confirmation. We will not resend payments returned due to incorrect payment email addresses. It is the sole responsibility of the affiliate to ensure that their payment email and all contact information is current and up-to-date.

Any sale made with the customer choosing the "monthly recurring" payment plan, or "split-payment plan" when offered, the affiliate will receive commission of up to 50% of every recurring monthly charge to the referred customer for the lifetime and terms of the payment plan, so long as the customer remains subscribed to the course, program, or product, and the affiliate remains in good standing as per this Agreement, or at the discretion of The Burnley Method.

All affiliates will be paid on the first of every month, and after a 30-day hold period to fulfill NewZenler's refund policy, making sure funds will always be available so that The Burnley Method is able to honor their non-negotiable "30-day money-back guarantee" refund policy. This means, for example: any affiliate sales made in the entire month of January will be paid out via PayPal on March 1st.

7. Order Fulfillment

The Burnley Method will be solely responsible for processing every order placed by a customer via Affiliate links. Affiliates are not authorized to collect payments, or sell any Burnley Method products from other websites as a "reseller" and no "resale" rights are granted in ANY way. Affiliates are not authorized to sell any of these products on eBay or other auction sites. Affiliates are not authorized to give away copies of any of these products or any included bonuses. The Burnley Method will also be solely responsible for all customer service inquiries. All affiliates understand and acknowledge that no physical products will be shipped.

Customers who purchase products and services through The Burnley Method Affiliate Program will be deemed to be customers of The Burnley Method. Accordingly, all rules, policies, and operating procedures concerning customer orders and service will apply to those customers. We may change our policies and operating procedures at any time. Prices and availability of our products and services may vary from time to time. The Burnley Method policies will always determine the price paid by the customer.

8. Qualifying Sites

The Burnley Method reserves the right to refuse any site entry into the Burnley Method Affiliate Program based on site content. Sites that do not qualify for the Affiliate Program include sites which:

Promote sexually explicit / or otherwise deemed pornographic materials
Promote violence
Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
Promote or participates in known avenues of disinformation
Promote illegal activities
List coupon codes or discounts that were NOT officially provided to them by The Burnley Method. Want to promote a coupon? Contact us and we will work that out with you directly. You may NOT promote coupon codes you may have found elsewhere online. Doing so may result in the termination of your affiliate account and withholding of affiliate payments for violating our Affiliate Agreement.
Infringe or otherwise violate any copyright, trademark, or other intellectual property rights of The Burnley Method or any other site.

9. Permitted Usage

The following are permitted uses of The Burnley Method brand and marketing resources:

Affiliates are permitted to use the graphical banners and design resources located in their affiliate portal, which is created and granted upon approval of becoming a member of The Burnley Method Affiliate Program. This portal is linked to your Burnley Method member account (you are considered a member when you make an account on theburnleymethod.com or are enrolled after acceptance of your Affiliate registration, regardless if you are enrolled in a course or not). This portal is accessible as a "course" that all affiliate members are automatically "enrolled" in, at no cost to the affiliate. This "course" contains access to all resources, information, and frequently asked questions in regards to your affiliate membership. If a specific size banner ad is not available, the affiliate may contact info@rogerburnley.com, and request a new banner graphic be added to the available resources.

10. Prohibited Usage

The following cases are prohibited, and are grounds for immediate termination of affiliate status, and possibly the entire student account:

Affiliates MAY NOT use The Burnley Method logo, logo marks, or other The Burnley Method website/branding imagery in a header graphic or in any way as to indicate that they are officially affiliated or partnered with The Burnley Method.
Affiliates MAY NOT use the term "The Burnley Method," "Roger Burnley Series," "Roger Burnley," "Your Life Operating Instructions," "4 Weeks to Your Best Life," or any permutation of products and memberships sold thereof, in ANY variation in their site URL. Example: "yourwebsitename.com/theburnleymethod" or "burnleymethod.yourwebsitename.com", etc.
Affiliates MAY NOT promote coupons that were not provided to them personally and directly by The Burnley Method. Want to promote a coupon? Contact us directly, and we will work it out with you. You may NOT promote coupon codes you may have found elsewhere online. Doing so may result in the termination of your affiliate account and the withholding of affiliate payments for violating our Affiliate Agreement.
Affiliates MAY NOT host or promote "coupon stacking" sites where customers may combine coupons to receive additional discounts.
Pay-Per-Click advertising is permitted through paid search advertising channels using non-branded search terms. We do not allow affiliates to bid on branded keyword terms including: The Burnley Method, Burnley Method, Roger Burnley, theburnleymethod.com, 4weekstoyourbestlife.com, rogerburnley, etc. Please contact us if you have any questions in regards to which terms are allowed or not.
IMPORTANT INFORMATION ABOUT FTC DISCLOSURE REQUIREMENTS: In 2009 the FTC released guidelines that require affiliates who use reviews, rankings, or testimonials to promote products to clearly disclose the fact that they receive compensation for doing so. We require all affiliates to comply with these guidelines. Failure to do so may result in removal from our affiliate program, and the cancellation of commissions. 11. The Burnley Method Anti-Spam Policy

The Burnley Method strictly prohibits affiliates from using spam email and other forms of Internet abuse (including spamming forums, blogs, Twitter, Facebook, and other social media outlets) to seek sales. Spam is defined as including, but not limited to, the following:

Electronic mail messages addressed to a recipient with whom the sender does not have an existing business or personal relationship, or is not sent at the request of, or with the express consent, of the recipient through an opt-in subscription.
Messages posted to Usenet, forums, Twitter, Facebook, and message boards that are off-topic (unrelated to the topic of discussion), cross-posted to unrelated newsgroups, posted in excessive volume, or posted against forum/message board rules. Be conscious of forum rules! If a forum owner or moderator complains that an affiliate has spammed, the affiliate account may be permanently terminated after investigation.
Content posted on free blog websites for the sole purpose of keyword spamming, or comments posted to legitimate blogs that violate the comment policy of the blog owner.
Solicitations posted to chat rooms, or to groups or individuals via Internet Relay Chat or "Instant Messaging" systems.
Certain off-line activities that, while not considered "spam", are similar in nature, including distributing flyers or leaflets on private property or where prohibited by applicable rules, regulations, or laws.

The Burnley Method may undertake, at its sole discretion, and with or without prior notice, the following enforcement actions:

Affiliate Account/Status Termination: Upon the receipt of a credible complaint, the Burnley Method Affiliate Program manager may investigate the complaint, and if necessary, will then terminate the affiliate account or affiliate status of the individual implicated in the abuse. Termination results in the immediate closure of the member and affiliate account or status, the loss of all referrals, and the forfeiture of any unpaid money pending on the account. This also may include the termination of enrollment in any of the programs the affiliate might have purchased as a member/customer of The Burnley Method. At The Burnley Method's discretion, termination may not only result in being banned from the affiliate program, but also being banned from any other internal affiliate programs.
Member Account Termination: Upon termination of the affiliate account, it is at the discretion of The Burnley Method to also terminate the member account, un-enrolling from any and all programs, if the affiliate also has purchased a product, program, or course -- and at the forfeiture of all payments rendered by the former affiliate/member for the product, program, or course up to the point of termination, and passed NewZenler's 30-day refund period. After 30 days, one-time payments will be forfeited and ineligible for refunds of any kind, as breaching any terms of service of The Burnley Method invalidates all eligibility for refund guarantees past 30 days of initial purchase. If enrolled in monthly subscriptions, or partial payments, all charges will cease on the month of termination immediately. If the account is terminated during a monthly recurring or payment plan after a charge on the month of termination, that charge is ineligible for refund and is forfeited by the former affiliate/member.

12. Relationship of Parties

Affiliates are independent contractors, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the parties. Affiliates have no authority to make or accept any offers or representations on our behalf. Affiliates will not make any statement, whether on their sites or otherwise, that reasonably would contradict this statement.

13. Term and Termination

The term of this Agreement will begin when you accept and will end when terminated by either party. Either The Burnley Method or the affiliate may terminate this Agreement at any time, with or without cause. Upon the termination of this Agreement for any reason, all licenses granted hereunder shall immediately terminate and you will immediately cease use of, and remove from Affiliate's Website, all links to the Burnley Method's websites, and all The Burnley Method trademarks and logos, other The Burnley Method marks and all other materials provided in connection with this program.

Most affiliates are qualified to participate in the Burnley Method Affiliate Program. However, we do reserve the right to refuse or revoke membership at any time if we determine that your website or marketing practices are questionable. Spamming is prohibited.

14. Limitation of Liability

The Burnley Method will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, expenditures, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Agreement and the Program will not exceed the total commissions paid or payable to the affiliate under this Agreement.

15. Disclaimers

We make no express or implied warranties or representations with respect to the Affiliate Program, or an affiliate's potential to earn income from the Affiliate Program. In addition, we make no representation that the operations of the websites or the Affiliate links will be uninterrupted or error-free, and The Burnley Method will not be liable for the consequences of any interruptions or errors.

16. Miscellaneous

Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to subsequently enforce such provision or any other provision of this Agreement. If any of the provisions of this Agreement are determined by a court to be unenforceable, they shall be severed from this Agreement, and the remaining provisions shall remain in full force and effect. By signing up with The Burnley Method Affiliate Program, you acknowledge that you have read this agreement and agree to all its terms and conditions. You have independently evaluated this program and are not relying on any representation, guarantee or statement other than as set forth in this Agreement.
